§ 58-99. Obstructions, encumbrances and nuisances.

  • (a)

    Prohibition. No person shall place or maintain any obstruction, encumbrance, or other nuisance upon a sidewalk in the village without first obtaining written permission from the village manager or his representative.

    (b)

    Maintenance. Property owners shall keep all sidewalks bordering their property free and clear of encroachments, debris, and all other obstructions and nuisances at all times.

    (c)

    Authority to maintain. The village council may, by a two-thirds vote of all trustees, contract with an independent contractor for the removal of all encroachments, debris, obstructions, and other nuisances from sidewalks, giving priority to sidewalks that facilitate school age pedestrian traffic. The cost of such maintenance shall be as provided for in section 58-97. The village shall not be responsible for damage to the sod, grass, or dirt immediately adjacent to the sidewalk.
