§ 74-73. Capital charges.

  • Capital charges shall be paid by users, prior to connection to or any service from the systems, for any premises which is connected to the water and/or sanitary sewer system, as follows:

    (1)

    Premises without available lines. Those premises which do not yet have water distribution or sanitary sewer collection lines available shall, unless the village council shall by resolution determine otherwise, pay the actual cost of constructing and installing such lines, plus a connection fee for each service.

    (2)

    Premises specially assessed. Those premises to which water and/or sanitary sewer service is now available and which were subject to special assessments for the cost of the construction of service lines or other portions of the systems shall pay those special assessments, plus a connection fee for each service.

    (3)

    Unassessed premises with available lines. Those premises to which water and/or sanitary sewer service is now available and which were not subject to special assessments, and for which no other payment has been made for the cost of the construction of those service lines or other portions of the systems, shall pay fees as follows:

    a.

    For parcels which are of a depth that they are or can be used for only one buildable lot, the charge shall be in an amount equal to the sum of the length of the frontage along the public right-of-way upon which the front yard of the property abuts (for corner lots, the right-of-way used shall be the right-of-way in which the service lines are located, whichever is longer) multiplied by the rates referred to in subsection (3)c of this section.

    b.

    For parcels which are of a depth that they are or can be used for more than one buildable lot or where service is requested for less than the entire parcel, the parcel shall be divided into the number of buildable lots into which it can be reasonably divided, which shall, for the purposes of this article, be presumed to be 75 feet in width and 100 feet in depth. The width of each buildable lot shall then be multiplied by the rates referred to in subsection (3)c of this section to determine the appropriate payment for the service lines.

    c.

    For water service and sewer service, the rates shall be as established from time to time by the village council.

    (4)

    Connection fees. Those connecting any premises to the system for the first time shall, prior to connecting to the system, pay a connection fee, based upon the meter size, according to the schedule as established from time to time by the village council. Where a premises does not have water service and is being connected only to the sanitary sewer system, the charge shall be based upon the meter size which would be installed if the premises were being connected to the water system.
